US Consumer Terms (Addendum)

Last updated: 21 September 2026

This US Consumer Terms Addendum (the "Addendum") applies to you if you are a consumer located in the United States, and supplements our Terms of Service. It is designed to comply with United States federal and state consumer-protection laws, including automatic-renewal laws and state privacy laws. Where this Addendum conflicts with the general Terms of Service as applied to US consumers, this Addendum controls.

Macrovelo is operated by ERISBIO SRL, Bdul. Independenței 266, Brăila, Romania. You can contact us at [email protected] (general/support) or [email protected] (privacy).

PLEASE READ SECTION 9 (BINDING ARBITRATION) AND SECTION 10 (CLASS-ACTION WAIVER) CAREFULLY. THEY AFFECT HOW DISPUTES BETWEEN YOU AND US ARE RESOLVED, REQUIRE MOST DISPUTES TO BE RESOLVED BY INDIVIDUAL ARBITRATION INSTEAD OF IN COURT, AND INCLUDE A RIGHT TO OPT OUT.

Your subscription is an automatically renewing subscription. This means that, until you cancel, we will automatically charge the payment method you provide the then-current subscription price at the beginning of each billing period (monthly, quarterly, or annually, as you selected).

Before you pay, we disclose clearly and conspicuously, and in close proximity to the request for payment: the recurring nature of the charges; the price that will be charged on renewal (and any introductory or trial price and when it ends); the length of the billing cycle; and how to cancel. You provide affirmative consent to these automatic-renewal terms before you are charged. We retain a record of that consent.

These practices are intended to comply with the federal Restore Online Shoppers' Confidence Act (ROSCA) and state automatic-renewal laws, including California's Automatic Renewal Law (Cal. Bus. & Prof. Code §§ 17600 et seq.) and similar laws in other states.

2. Free trials and introductory offers

If your plan includes a free trial or introductory/discounted price, the price, the date the trial or introductory period ends, and the price you will be charged afterward are disclosed before you sign up. A valid payment method is required to start a free trial (you are charged €0 today). Unless you cancel before the trial or introductory period ends, your subscription will automatically continue and your payment method will be charged the standard price disclosed at sign-up. You must cancel before the trial ends to avoid being charged.

3. How to cancel (easy, online, one click)

You can cancel at any time, online, in one click, from your account settings or the customer portal — using the same method you used to sign up and without calling, chatting, or speaking to anyone. We do not use retention hurdles, hard-to-find cancellation flows, or other 'dark patterns'.

Cancellation takes effect at the end of your current billing period and stops all future renewal charges. You keep access to paid features until the end of the period you have already paid for.

4. Renewal and trial reminders; right to cancel before renewal

Where required by applicable state law (including for free-to-pay conversions and for certain annual or longer terms, and for material changes to the subscription), we send you a reminder before you are charged. The reminder includes the renewal price, the renewal date, and a direct method to cancel. You always have the right to cancel before a renewal to avoid the next charge.

5. Your state privacy rights

Depending on your state of residence (for example California under the CCPA/CPRA, and Virginia, Colorado, Connecticut, Utah, Texas, Oregon, and other states with comprehensive privacy laws), you may have some or all of the following rights, subject to legal exceptions:

  • The right to know and access the categories and specific pieces of personal information we have collected about you, the sources, the purposes, and the categories of recipients
  • The right to delete personal information we have collected from you
  • The right to correct inaccurate personal information we hold about you
  • The right to obtain a portable copy of your personal information
  • The right to opt out of the 'sale' or 'sharing' of personal information and of targeted advertising
  • The right to limit the use and disclosure of sensitive personal information
  • The right to opt out of certain automated decision-making or profiling, where applicable
  • The right not to receive discriminatory or retaliatory treatment for exercising any of these rights

6. We do not sell your personal information for money

We do not sell your personal information for money. If you use the site with advertising or analytics cookies enabled, some disclosures for advertising or measurement could be treated as a 'sale' or 'sharing' (including for 'targeted advertising') under certain state laws. You can opt out at any time by rejecting non-essential cookies in our cookie banner, by using any "Your Privacy Choices" / "Do Not Sell or Share My Personal Information" control we provide, by enabling a recognized opt-out preference signal (such as Global Privacy Control) in your browser, or by emailing [email protected].

7. Sensitive information and health data

Some information you provide (for example weight, dietary, and other health-related information) may be considered "sensitive personal information" under state law. We use it only to provide and personalize the Service as described in our Privacy Policy, and not for incompatible purposes. We are not a "covered entity" or "business associate" under HIPAA, and the information you provide to Macrovelo is generally not protected health information under HIPAA.

8. How to exercise your rights

To exercise any of the rights above, email [email protected] or use the in-app data-export and account-deletion tools. You may use an authorized agent to submit a request on your behalf; we will take reasonable steps to verify your identity and the agent's authority as permitted by law. We will respond within the timeframes required by your state's law (generally within 45 days, with an extension where permitted) and will not discriminate or retaliate against you for exercising your rights. If we decline a request, you may appeal by replying to our response, and where applicable you may contact your state Attorney General.

9. Binding individual arbitration

Please read this section carefully. Except for the disputes described below, you and ERISBIO SRL agree that any dispute, claim, or controversy arising out of or relating to the Service, these Terms, or this Addendum will be resolved by final and binding individual arbitration, rather than in court, on an individual basis, under the rules of a recognized arbitration provider and the Federal Arbitration Act.

This arbitration agreement does not apply to: (a) disputes that may be brought in small-claims court if they qualify; (b) actions to protect intellectual-property rights; or (c) any claim or right that, under applicable law, cannot be required to be arbitrated. Nothing here prevents you from bringing matters to the attention of federal, state, or local agencies, which may seek relief on your behalf.

Right to opt out: You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing [email protected] with your name, account email, and a clear statement that you opt out of arbitration. Opting out will not affect any other part of these Terms.

10. Class-action and jury-trial waiver

To the fullest extent permitted by law, you and we agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. Unless both you and we agree otherwise in writing, an arbitrator may not consolidate more than one person's claims or preside over any form of a representative or class proceeding. Where this waiver, or arbitration itself, is found unenforceable for a particular claim, that claim (and only that claim) may proceed in court. To the extent permitted by law, you and we waive any right to a jury trial.

11. Refunds

Our cancellation, withdrawal, and voluntary money-back terms are described on the Refunds & Cancellation page. Nothing in these Terms or this Addendum waives any non-waivable right you have under the consumer-protection law of your state.

12. Governing law and venue

Except where preempted by the Federal Arbitration Act or other federal law, and without depriving you of the mandatory consumer-protection rights of your state of residence, the general Terms' governing-law provisions apply. For any matter not subject to arbitration, you may bring proceedings where the law of your state permits. We encourage you to contact us first so we can try to resolve any issue directly.
